Terms of Use.

These Terms of Use govern your use of the Podchat iOS app and related website features. By using Podchat, you agree to these terms.

Using Podchat

Podchat lets you listen to podcasts and ask voice questions about the episode you are currently playing. You may use the app only in a lawful manner and only for personal, non-commercial use unless we agree otherwise in writing.

"Podchat" (or the "Service") means the Podchat iOS app together with our hosted backend, including the voice question-and-answer service that processes your questions and returns generated audio and text responses. Parts of Podchat only work while connected to this backend.

License and ownership

The Podchat app is licensed to you, not sold. We grant you a personal, limited, non-exclusive, non-transferable license to use Podchat on Apple devices you own or control, subject to these terms and to Apple's App Store Usage Rules. You may not sell, rent, sublicense, redistribute, or transfer the app, or make it available over a network where multiple devices could use it at once.

Podchat is operated by Interactive Media Inc., a Delaware corporation. Podchat, including its software, design, branding, and content we provide, remains the property of Interactive Media Inc. and its licensors. We reserve all rights not expressly granted to you.

Subscriptions and billing

Podchat offers a free tier and two optional paid subscription tiers: Pro, which includes 100 voice minutes per month, and Max, which includes 500 voice minutes per month. Each paid tier's price, billing period, and included minutes are shown in the app before you subscribe. These allowances are monthly caps and are subject to the fair-use limits below.

Purchases are made through Apple's in-app purchase system and are billed to your Apple ID account at confirmation of purchase. Your subscription is an auto-renewable subscription: it renews automatically for the same period, at the then-current price, unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID is charged for the renewal within 24 hours before the current period ends.

You can manage or cancel your subscription at any time in your App Store account settings. Cancellation takes effect at the end of the current billing period, and you keep access to your paid tier until then. Because subscriptions are sold through Apple, we cannot cancel a subscription on your behalf — you must do so through Apple.

How voice minutes are counted: your monthly allowance is consumed by the measured length of the spoken exchange (your speech and the app's spoken responses), not by the total time an episode is open or playing. Unused minutes do not roll over and reset at each renewal. If you upgrade, downgrade, or change tiers, the change and its effective date are shown in the app.

Payments are non-refundable except where required by law, and we do not provide prorated refunds for a partially used billing period. Apple handles payment processing, subscription management, refund requests, and any applicable taxes according to Apple's terms and policies, and any refund is at Apple's discretion.

We may change subscription prices or the features and limits included in a tier. If we increase the price of your subscription, the change applies to renewals after we provide notice as required by Apple and applicable law, and Apple may ask you to confirm the new price before it takes effect. If you do not agree to a price increase, you can cancel before your next renewal.

Acceptable use

You may not use Podchat to violate any law, interfere with the app's operation, attempt unauthorized access, or copy, scrape, reverse engineer, or misuse the service beyond what applicable law allows.

Your questions and inputs

When you ask a question, Podchat sends your question and related context (such as the podcast and playback position) to our backend so it can generate a response. You are responsible for what you submit, and you must not submit content that is unlawful or that infringes the rights of others. You grant us permission to process your inputs to operate and improve the Service, including by passing them to the third-party AI and text-to-speech providers we use to generate responses. How we handle this data is described in our Privacy Policy.

AI-generated responses

Podchat generates synthetic voice and text responses based on podcast content and your question, using third-party artificial-intelligence and text-to-speech providers. These responses are generated by AI and are not created, endorsed, or spoken by the podcast's hosts, guests, or any real person featured in the episode, and they do not represent those people's views, statements, or endorsements — even where a synthetic voice or phrasing may resemble them. Responses may be incomplete or inaccurate and are provided for general informational or entertainment purposes only. They are not professional advice.

Fair use and service limits

Paid and free tiers include usage limits, such as a monthly allotment of voice minutes or questions. You may use the Service only through the official Podchat app and only for your personal use. You may not automate, resell, or share access to the Service, attempt to exceed or circumvent usage limits, overload or interfere with our backend, or extract, scrape, or reverse engineer the Service or the models and data behind it. We may apply rate limits and may suspend or limit access that we reasonably believe is abusive, fraudulent, or in breach of these terms.

Podcasts and third-party content

Podcast audio, artwork, and related material are provided by third parties and remain the property of their respective owners. Podchat is not responsible for the content, accuracy, or availability of any third-party podcast or external service, and access to it may change or be removed at any time. You use third-party content at your own risk and agree to comply with any applicable third-party terms.

Availability and changes

We may update, improve, limit, or discontinue parts of Podchat at any time. We do not guarantee that the app will always be available, uninterrupted, or error-free.

Disclaimer of warranties

Podchat is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law. We do not warrant that the app will meet your requirements or that its operation will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of liability

To the extent not prohibited by law, Podchat and Interactive Media Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use Podchat, however caused and regardless of the theory of liability, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total liability to you for all claims will not exceed the greater of the amount you paid for the app in the twelve months before the claim or fifty US dollars ($50). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

Termination

These terms apply until terminated. Your rights under these terms end automatically if you fail to comply with them. You may stop using Podchat at any time. Upon termination you must stop using the app; the License and ownership, Disclaimer of warranties, Limitation of liability, and Governing law sections survive termination.

Export compliance

You may not use or export Podchat except as authorized by United States law and the laws of the jurisdiction where you obtained it. In particular, the app may not be exported to U.S.-embargoed countries or to anyone on a U.S. government restricted-party list. By using Podchat you represent that you are not located in such a country or on such a list.

Governing law and disputes

These terms are governed by the laws of the State of California, USA, excluding its conflict-of-law rules. You agree that any dispute arising from these terms or your use of Podchat will be resolved in the state or federal courts located in the City and County of San Francisco, California, and you consent to their personal jurisdiction, except where applicable consumer-protection law gives you the right to bring a claim in your place of residence.

Your use of Podchat is also subject to our Privacy Policy.
